These Additional Terms apply to your use of NationBuilder. Remember that your use of 3dna's Services (including NationBuilder) is at all times subject to our Master Terms of Service (the "Master Terms"), which incorporate these Additional Terms. Any terms we use in these Additional Terms without defining them have the definitions given to them in the Master Terms.

Use of NationBuilder
We've provided extensive guidance on how to use NationBuilder in our Support section and welcome your questions.
Your Data
3dna provides NationBuilder customers with their own isolated private database so that your data is completely separate from anyone else's data. Your private data is never shared with anyone unless you decide to do it yourself. You can snapshot and download your entire database, or export select data into spreadsheets. We believe your data ownership is important and we've made the exporting process very simple. You have complete ownership of the data in your nations.
3dna is free to display content posted to public areas of NationBuilder websites and, to the extent reasonably necessary to provide you with the Service, to transmit and store private data on your behalf. We may also duplicate data to provide backups and continuity of service.
Data that is subject to third-party terms or policies or other obligations continues to be governed by those terms, policies and obligations when you are using NationBuilder.
Law Enforcement and Third-Party Complaints
We do not actively monitor, supervise or censor any content or data that belongs to or is provided by 3dna customers and will refuse to honor any third-party requests to inspect customer data unless we are required to do so by law or subpoena, or directed by our customer to supply information to assist in a lawful investigation. In event of a lawful request for customer data initiated by a third party, to the extent that we are legally permitted to do so, we will make every effort to notify you and give you opportunity to challenge such access.
If we receive a third-party complaint about your public content or data practices, we may forward the complaint to you for resolution. 3dna will not mediate or be liable for any dispute over your NationBuilder content, even if you ignore it or fail to resolve the complaint to a third party's satisfaction. However, if we determine that hosting your content or data would make us criminally or civilly liable, we may require you to immediately remove the content or data from NationBuilder or post a bond equal to our projected liability for hosting that content, as solely determined by 3dna.
Billing and Pricing
Most customers pay for NationBuilder on a month-to-month basis, but you can also purchase a custom plan and term – just contact us at [email protected] or speak to your organizer for a custom quote. You will be responsible for paying, withholding, filing, and reporting all taxes, duties, and other governmental assessments associated with your activity in connection with the Services, provided that 3dna may, in its sole discretion, do any of the foregoing on your behalf or for itself as it sees fit.
NationBuilder customers will be billed for NationBuilder upon the end of the free trial period and on a recurring basis depending on their plan, at the beginning of their term. Many plans are based on the number of people or email addresses in your nation, so price may increase or decrease between billing periods.
Manipulating usage to avoid fees is not allowed and may result in shutdown of your nation. Websites created using NationBuilder must include "Created with NationBuilder" and a hyperlink to NationBuilder.com on the home page.
We may change our fees and associated features, and current pricing rates are available here. We do not provide refunds.
3dna is not liable for the actions or inactions of a payment processor. If your account goes overdue or charges are reversed, we may shut down your nation.
Pause and Shutdown
You can close your nation in two ways and will not be billed for either of these:
- If you pause your nation, it will not be accessible except to unpause. While your nation is paused, we will make every reasonable effort to preserve your content and data and allow you to resume service at a future date under the pricing in effect at the time.
- If you shut down your nation, we make every reasonable effort to permanently remove your data from our services, usually within 30 days. You will not be able to recover your nation in the future. Content posted publicly on websites may remain accessible through third-party archives.
Confidentiality & Security
All employees of NationBuilder agree to strict confidentiality provisions that provide for the protection of all customer data. We take this extremely seriously; any willful violation of customer confidentiality is a fireable offense and grounds for legal action. In order to provide customer support, a 3dna employee may access your nation on your behalf.
3dna only exposes services to the internet that are correctly secured using industry-standard practices. We have a strong focus on security and continuously find ways to improve both our monitoring and the software itself to prevent unauthorized access. We periodically solicit third-party security audits and incorporate findings into our practices and infrastructure.
All access to NationBuilder control panels and donation processing is protected via SSL.
To protect your privacy and security, we take reasonable steps (such as requesting a unique password) to verify identity before granting you access to NationBuilder. You are responsible for maintaining the secrecy of your unique password and account information (as well as all activity that occurs on your account).
For internal purposes, we may use your customer data, nation data and usage data to create aggregated anonymized statistics and to increase the usability of NationBuilder. You acknowledge that we are free to use this aggregated, anonymized data in any manner, provided that it cannot be used in any way to identify you or any of your users.
Privacy
Any personally identifiable information that we collect about you as a customer (as opposed to personal information that you provide or collect regarding your own users) is governed by our Privacy Policy.
As a NationBuilder customer, you are responsible for advising users and visitors to your sites on how you use private data and content posted to your sites. 3dna has provided a model privacy policy for customer use that describes how NationBuilder works. Please note that this policy is provided for informational purposes only, and does not constitute legal advice. You should consult with appropriate legal counsel to ensure (and you hereby represent and warrant to 3dna) that your activities on NationBuilder will comply with all applicable laws.
Through the NationBuilder API, third-parties authorized by NationBuilder administrators may access information about users. This access is governed by any the terms and policies of those third parties and nation owners.
Conflict of Interest
NationBuilder is a platform available to everyone and we don't discriminate. Because we have many political customers, our employees agree to the following.
As a company:
- We do not take sides in political campaigns.
- Regardless of ideology, we strive to make every NationBuilder customer successful with the platform.
- We are happy to provide advice on NationBuilder and digital strategy in general to any campaign that asks, whether they are NationBuilder customers or not.
- We do not accept consulting fees for strategy from any political organizations.
- We charge only for software subscription fees and for training, data and support services.
As individual staff:
- We all generally vote and are politically active. Any views expressed on Twitter or elsewhere online are as individuals. We do not hide our individual political views, preferring transparency, and we don't all agree.
- Individually, we do not accept consulting fees or serve in any official capacity for any political or governmental organizations.
NationBuilder API
NationBuilder's application programming interfaces ("API") allow you to create applications that interface with NationBuilder. Use of the API is subject to NationBuilder's Developer policies and rate limits set forth at www.nationbuilder.com/developers, which may change from time to time. Use of the API grants you no special privileges and 3dna may monitor your applications for compliance with our terms and policies. We assume no liability for use of the API and do not endorse or warrant third-party applications.
