Effective date: January 1, 2020
This CCPA Data Processing Addendum (“CCPA DPA”) forms part of the Master Terms of Service or other written or electronic agreement between 3DNA and Customer for the use of 3DNA’s online NationBuilder Service (“Services”) for the processing of Customer Data, including Personal Data (each such agreement is referred to herein as the “Agreement”).
In consideration of the mutual obligations set out herein, the parties hereby agree that this CCPA DPA shall be added as an addendum to the Agreement to govern processing by 3DNA of any Customer Data that is subject to the California Consumer Privacy Act, Cal, Civ. Code 1798.100 et seq., (“CCPA”), including any amendments and implementing regulations that become effective on or after the effective date of this CCPA DPA.
For the purposes of the CCPA, the parties agree that 3DNA is a “Service Provider” (as defined in the CCPA), in the performance of its obligations pursuant to the Agreement, and that Customer is a “Business (as defined in the CCPA).
3DNA shall not retain, use or disclose CCPA Personal Information for any purpose other than for the specific purpose of providing the Services specified in the Agreement or as otherwise permitted by the CCPA. 3DNA acknowledges and agrees that it shall not retain, use or disclose CCPA Personal Information for any commercial purpose, other than providing the Services.
3DNA will provide reasonable assistance and cooperation to Customer in its response to verifiable CCPA Consumer rights requests, as required by applicable CCPA requirements. 3DNA shall promptly notify the Customer of any request received by it from a Consumer and shall not respond to the Consumer other than to inform them that their request has been redirected to the appropriate Customer.
